FocusFlow Terms of Use
Effective EFFECTIVE_DATE
These terms are an agreement between you and DEVELOPER_NAME ("we", "us"), who provides the FocusFlow app and its online service ("FocusFlow"). By using FocusFlow you agree to them. If you don't agree, please don't use it. Our Privacy Policy explains how we handle your information.
1. Who can use FocusFlow
You must be at least 13 years old, or older if the law where you live requires it to use an app like this on your own. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you, and is responsible for any purchases.
2. Your account
You can use FocusFlow without an account, or sign in with Google to sync between devices. Keep your Google account secure; you're responsible for what happens in FocusFlow under it. You can delete your account at any time in the app (Profile → Delete Account) or as described on this page.
3. Your content
What you put in FocusFlow (tasks, routines, notes, places and so on) stays yours. You give us permission to store, copy and process it only as needed to run FocusFlow for you, such as syncing it and planning your schedule. That permission ends when you delete the content or your account, apart from copies that expire as the Privacy Policy describes. Keep your own copy of anything you can't afford to lose.
4. FocusFlow plans; you decide
FocusFlow arranges a schedule automatically, using your calendar, the weather and estimated travel times. It's a planning aid, and it can be wrong or late:
- It moves smart tasks when plans change. Use "Lock in place" for anything that must stay where it is.
- Weather forecasts and travel times come from outside services and are estimates.
- Reminders and notifications depend on your device. Battery saving, "do not disturb", denied permissions, a phone that's off or offline, or the operating system can delay or block them.
- Syncing needs an internet connection and may not be instant.
Don't rely on FocusFlow alone for anything important or time-critical, such as medical appointments, medication, travel, legal or work deadlines, or anything where a missed or late reminder could cause harm or loss. Check important commitments yourself. Nothing in FocusFlow is medical, health, fitness or professional advice. Don't use the app while driving.
5. FocusFlow Pro and payments
- FocusFlow has a free plan with limits shown in the app, and a paid subscription, FocusFlow Pro, with the features described on the subscription screen. We may change which features are in each plan; if a change takes away something you've paid for, it won't apply until your current paid period ends.
- Subscriptions are sold and billed by Google Play to your Google account, at the price and for the period (monthly or yearly) shown before you buy, plus any applicable taxes.
- Subscriptions renew automatically at the end of each period until you cancel. If an offer starts with a free trial, you're charged when the trial ends unless you cancel before then; free trials and other offers are available only as Google Play allows, usually once per person. If the price changes, Google Play tells you before you pay the new price, as its rules require.
- Cancel any time in the Google Play Store (Payments & subscriptions → Subscriptions). Pro stays on until the end of the period you've paid for. Deleting the app or your account does not cancel a subscription.
- Refunds are handled under Google Play's refund policies, except where the law gives you other rights.
- When Pro ends, nothing is deleted. Smart tasks beyond the free plan's limit become regular tasks at the times they had (the one you edited most recently stays smart), and you can't add more than the free plan allows until you subscribe again.
6. Prohibited conduct
Your right to use FocusFlow depends on complying with this section. You must not, and must not help, encourage or allow anyone else to:
- copy, modify, adapt, translate, decompile, disassemble or reverse engineer FocusFlow, or attempt to derive its source code, except to the extent applicable law expressly permits it despite this restriction;
- circumvent, disable or interfere with any subscription, licensing, payment, integrity or security measure, including by using, creating or distributing cracked, patched, modified or unofficial copies of the app;
- obtain or use paid features without a valid subscription purchased through Google Play;
- access or attempt to access any account, data or system you are not authorized to access, or probe, scan or test the vulnerability of FocusFlow or the systems it runs on;
- overload, disrupt or impair the service, or access it by automated means (such as bots, scrapers or scripts) or through any interface other than the official app;
- sell, resell, rent, sublicense, distribute or commercially exploit FocusFlow, or use it to build or benchmark a competing product;
- remove, obscure or alter any notice, credit or attribution in the app;
- use FocusFlow for any unlawful, fraudulent or harmful purpose, or in violation of anyone's rights.
Violations have consequences. FocusFlow uses technical measures to detect tampering and unauthorized use. If we reasonably believe you have breached this section, we may, at our sole discretion and without prior notice:
- immediately suspend or permanently terminate your account and your access to FocusFlow, including any paid features, without refund to the extent the law allows;
- block the device or copy of the app involved from the service;
- report the matter to Google, our service providers and law enforcement, and share relevant information with them;
- take legal action against you, including seeking damages, recovery of our costs and court orders to stop the conduct.
Circumventing technical protection measures, or accessing FocusFlow's systems without authorization, may also be an offence under copyright and computer misuse laws, including Canada's Copyright Act and Criminal Code. These remedies are in addition to any others available to us under these terms or the law.
7. Other services
FocusFlow works with services we don't control, under their own terms: Google sign-in, Google Calendar and Google Play; weather data from Google; and place search and travel times from LocationIQ, with map data © OpenStreetMap contributors. We're not responsible for those services, and features that depend on them may change or stop if they do.
8. Our rights in FocusFlow
FocusFlow, its design, code and name belong to us or our licensors. These terms give you a personal, non-exclusive, non-transferable right to use the app on devices you own or control, for as long as you follow them. If you send us suggestions, we can use them without owing you anything.
9. Changes and availability
We keep improving FocusFlow and may add, change or remove features. We may also stop offering FocusFlow; if we do, we'll give reasonable notice where we can, so you can delete your data, and we won't keep charging for a service that no longer exists. Test (beta) versions may be less reliable than released ones.
10. Disclaimer
FocusFlow is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties beyond those in these terms, including that FocusFlow will be uninterrupted, error-free or fit for a particular purpose, or that reminders, schedules, weather or travel times will be accurate or on time.
11. Limits on our liability
To the fullest extent the law allows, we're not liable for indirect, incidental, special or consequential losses, such as missed appointments, lost time, lost profits or lost data, arising from your use of FocusFlow, even if we were told they were possible. Our total liability for any claim about FocusFlow is limited to the greater of what you paid for FocusFlow in the 12 months before the claim and 50 Canadian dollars.
12. Your rights as a consumer
Nothing in these terms limits liability that can't be limited by law, such as for fraud or for harm we cause on purpose or through gross negligence, or takes away rights you have as a consumer under the laws where you live. Where those laws don't allow a part of sections 10, 11 or 13, that part doesn't apply to you.
13. If you misuse FocusFlow
To the extent the law allows, if you break section 6 or use FocusFlow unlawfully and someone makes a claim against us because of it, you'll cover our reasonable losses and costs from that claim.
14. Ending these terms
You can stop using FocusFlow and delete your account at any time. These terms end when you do, or if we end your access under section 6. Sections 3 (as to copies that expire), 8, and 10 to 17 keep applying afterwards.
15. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless the law where you live as a consumer gives you the right to bring them in your local courts or under your local laws. Before going to court, please contact us first; most problems can be solved that way.
16. Changes to these terms
We may update these terms. We'll post the new version here with a new effective date, and let you know before a significant change takes effect, in the app's release notes or by email if you're signed in. If you keep using FocusFlow after that, the new terms apply; if you don't agree, stop using it and cancel any subscription.
17. General
These terms, with the Privacy Policy, are the whole agreement between us about FocusFlow. If a part of them can't be enforced, the rest still applies. If we don't enforce a part right away, we can still enforce it later. We're not responsible for delays or failures caused by events beyond our reasonable control, such as outages of the services FocusFlow relies on. You may not transfer these terms to anyone else; we may transfer them to a successor that takes over FocusFlow.
